GENERAL TERMS AND CONDITIONS

The General Terms and Conditions of the the-slovenia.com online store have been drawn up in accordance with the Slovenian Consumer Protection Act (ZVPot-1), the recommendations of the Chamber of Commerce and Industry of Slovenia, and international codes of conduct for e-commerce.

The the-slovenia.com online store is operated by Regio Vita d.o.o. (hereinafter referred to as the “Provider”), an e-commerce service provider. Upon registering on the-slovenia.com, the visitor receives a username, which is the same as their email address, and a password. The username and password uniquely identify the user and link them to the information provided. By registering, the visitor becomes a user and obtains the right to make purchases.

These General Terms and Conditions govern the operation of the the-slovenia.com online store, the rights of users, and the business relationship between the Provider and the customer.

AVAILABILITY OF INFORMATION

The Provider undertakes to make the following information available to the customer at all times:

  • the identity of the company, including its name, registered office and registration number;

  • contact details that enable users to communicate with the Provider quickly and efficiently, including an email address and telephone number;

  • the essential characteristics of the goods or services, including after-sales services and warranties;

  • product availability (each product or service offered on the website should be available within a reasonable period);

  • the terms of delivery or performance of services, including the method, location and estimated delivery time;

  • clearly and unambiguously stated prices, including information on whether taxes and delivery costs are included;

  • available payment and delivery methods;

  • the period for which the offer remains valid;

  • the period within which the customer may withdraw from the contract, the conditions governing withdrawal and information regarding the cost of returning the goods;

  • an explanation of the complaints procedure, including the relevant contact person or customer service contact details.

Due to the nature of online business, the product range available on the-slovenia.com is updated and changed frequently and rapidly.

PRICES

The same prices apply to all users of the-slovenia.com.

All prices include VAT unless explicitly stated otherwise.

Prices are valid at the time the order is placed and do not have a predetermined period of validity.

Despite the Provider’s best efforts to ensure that all information is current and accurate, pricing errors may occasionally occur. If this happens, or if the price of an item changes while an order is being processed, the Provider will allow the customer to withdraw from the purchase and will offer a mutually satisfactory solution.

Discounts, promotional codes and similar offers cannot be combined. Funds paid in the form of gift vouchers, bonuses or advance payments do not accrue interest.

The Provider will deliver the goods or perform the service within the agreed period. The Provider reserves the right to select another delivery service if this allows the order to be fulfilled more efficiently and in accordance with the delivery price or cost specified when the order was placed.

COMMUNICATION

The Provider may contact the user through the available communication channels to clarify an order or delivery address and to provide information about news and promotional offers. Promotional communications will only be sent where permitted and in accordance with the user’s expressed communication preferences.

The Provider carefully protects the personal information and contact details supplied by users when registering or placing an order and processes them in accordance with applicable personal data protection legislation.

USER REVIEWS AND COMMENTS

User opinions, comments and product reviews submitted by customers form part of the online store’s functionality and are intended for the user community. Any registered user may submit a review. The Provider reviews submitted content before publication.

The Provider will not publish reviews or contributions that are offensive, obscene or, in the Provider’s opinion, do not provide useful information to other users and visitors.

By submitting a review or comment, the user expressly agrees to these Terms and Conditions and grants the Provider permission to publish all or part of the submitted text in electronic and other media. The Provider may use the content without any time limitation and for any purpose connected with its legitimate business interests, including its publication in advertisements and other marketing communications.

The author of the review also represents and warrants that they hold the relevant rights to the submitted reviews and comments and grants the Provider a non-exclusive, unlimited licence to use such content.

DISCLAIMER

The Provider makes every effort to ensure that the information published on its website is current and accurate. Nevertheless, product characteristics, delivery times or prices may change so quickly that the Provider is unable to update the published information in time.

In such cases, the Provider will notify the customer of the changes and allow them to withdraw from the order or replace the ordered item.

Although the Provider makes every effort to provide accurate product photographs, all photographs should be regarded as illustrative. Photographs do not guarantee the exact characteristics or appearance of a product.

COMPLAINTS AND DISPUTES

The Provider complies with the applicable consumer protection legislation. The Provider makes every effort to establish an effective complaints-handling system and to designate a person whom customers may contact by telephone or email if they experience any difficulties.

The Provider will acknowledge receipt of a complaint within five working days, inform the customer of the expected processing time and keep the customer informed throughout the procedure.

The Provider recognises that a key feature of consumer disputes, particularly in the case of judicial proceedings, is the disproportion between the economic value of the claim and the costs incurred in resolving the dispute. This is often the main reason why consumers do not bring disputes before the courts. The Provider will therefore make every reasonable effort to resolve disputes amicably.

PURCHASING PROCESS

1. Order received

After placing an order, the customer receives an email confirming that the order has been received and is being processed. Information regarding the status and contents of the order is available to the customer on the Provider’s website.

2. Order confirmed

The order proceeds to further processing. The Provider reviews the order, verifies the availability of the ordered products and either confirms or rejects the order, stating the reason for rejection.

The Provider may contact the customer using the telephone number provided to verify information or ensure accurate delivery.

Once the order has been confirmed, the Provider will notify the customer by email of the estimated delivery time. At this stage, the sales contract for the ordered products is concluded between the customer and the Provider.

3. Goods dispatched

The Provider prepares and dispatches the goods within the agreed period and notifies the customer by email.

The email also contains information about the returns policy, who to contact in the event of a delivery delay and where to submit a complaint.

4. Electronic invoice

The customer receives an electronic invoice for the purchased goods by email. An electronic invoice is an invoice issued by the Provider to the customer in electronic form for delivered goods or services performed and is equivalent to a paper invoice.

PAYMENT METHODS

The Provider offers the following payment methods:

  • cash on delivery;

  • payment by bank transfer to the account of Regio Vita d.o.o., based on an offer or pro forma invoice and using a UPN payment form;

  • payment by Visa, Visa Electron, Mastercard or Maestro credit or debit card.

The Provider issues the customer with an electronic invoice containing an itemised breakdown of costs and instructions on how to withdraw from the purchase and return the products where this is necessary and permitted.

The sales contract, represented by the order, is stored electronically on the Provider’s server.

PAYMENT AND CREDIT CARDS

The following additional conditions apply to payments made by debit or credit card:

Ordered goods may be paid for securely online using a Visa, Visa Electron, Mastercard or Maestro debit or credit card when the order is placed.

The person or organisation making the payment must be the cardholder. Purchases made using a Maestro card are only possible if the cardholder’s bank permits online transactions.

The Mastercard SecureCode service is available to Mastercard and Maestro cardholders whose cards are issued by banks participating in the Bankart system.

Once receipt of the order has been confirmed, the contents or final value of the order cannot be changed, except in exceptional circumstances and with the approval of Regio Vita d.o.o.

RETURNS

A customer who orders products from the the-slovenia.com online store and is not satisfied with the ordered products, or wishes to withdraw from the contract for any other reason, may notify the company of their withdrawal within 14 days of receiving the product.

The withdrawal notice must be sent to info@the-slovenia.com. The customer is not required to state a reason for their decision.

The customer must return the goods within 14 days of notifying the Provider of their withdrawal. The goods must be returned undamaged and in an unchanged quantity to the address provided by the Provider, as returned goods may be sent directly to the supplier.

The Provider will refund all payments received from the customer within 14 days of receiving the withdrawal notice, without the customer having to request the refund separately.

The customer is responsible for the direct costs of returning the goods.

Returned products must be unused, undamaged and in their original packaging.

A copy of the invoice must be enclosed with the returned goods.

CUSTOM-MADE PRODUCTS

The right to withdraw from the purchase within 14 days without stating a reason does not apply to products made to the customer’s specifications or clearly personalised.

For custom-made products, the customer may submit a complaint within 60 days. The complaint must be submitted in writing and must include:

  • an exact description of the product or products concerned;

  • a description of the defect being reported; and

  • the original invoice.

The customer must allow the company to inspect the product.

The company will respond to the customer no later than eight days after receiving the complaint. If the complaint is justified, the company will offer to remedy the defect, provide a replacement product or allow the customer to withdraw from the contract.
